What is H1B Visa ?

The H-1B is a non-immigrant visa in the United States that allows US employers to temporarily employ (sponsor) foreign workers in specialty occupations. If a foreign worker in H-1B status quits or is dismissed from the sponsoring employer, the worker must either apply for or be granted a change of status to another non-immigrant status, find another employer or leave the US.

H1B Visa Requirements

To qualify for an H1B visa to work in the US, a foreign worker must have a temporary offer of employment in a specialty occupation from a US employer.

A specialty occupation is an occupation that requires theoretical and practical application of specialized knowledge that usually requires the equivalent of at least a bachelor’s degree or equivalent work experience. Typical specialty occupation fields include architecture, engineering, mathematics, physical sciences, medicine, health, education, business specialties, accounting, law, theology and the arts. Fashion models of distinguished merit and ability may also qualify for an H1B visa.

Authorization is strictly limited to employment by the sponsoring employer only. If the worker wants to change companies, the new employer would need to apply for a transfer and request to become the worker’s new sponsor H1B visa applicants may also be required to meet certain health and character requirements.

H1B Visa Entitlements

An H1B visa entitles the holder to live and work in the US temporarily. An H1B visa is usually granted for an initial period of 3 years and extensions may be granted. Foreign workers with an H1B visa are permitted dual intent, meaning the applicant can maintain H1B visa status while applying for a Green Card to remain in the US permanently.

Spouses and unmarried children under 21 years of age may apply for the applicable derivative visa (H4 visa) to join their spouse or parent in the US. Accompanying spouses and children are entitled to study in the United States but are not entitled to undertake any employment without obtaining an appropriate work visa.

Important Highlights

The US immigration legislation caps the number of H1B visas issued to 65,000 per fiscal year (from October 1 to September 30). The United States Citizenship and Immigration Services (USCIS) starts accepting applications on the first business day of April for visas that count against the fiscal year starting in October. If there are more applications than available visas, there is a lottery system that decides whose application makes it through for that year

What candidates need to know if transferring your H-1B visa to a consulting or staffing company?

  • The company is reputable and has a high h1b visa approval rate (and is not blacklisted).
  •  The company’s policy if you go on the bench or your project ends. Some US consulting companies immediately terminate your employment if they can’t find you a project and you risk going out of status if this happens.
  • Clarify if the company will extend your visa when it expires and if they will process your greencard if you wish to do so and how soon it will start the process.
